To obtain spouse visa, you must meet the following requirements:
You must be legally married. Merely living together does not qualify a marriage for immigration Unmarried partners are ineligible to sponsor visas to the United Stated.
You must be 18 years old before you can sign the Affidavit of Support, which is a form that will be required later in the process.
You are also required to satisfy health and character requirements.
The marriage must still be in existence;
An appointment package is sent to the agent or the applicant.The appointment package gives the applicant an interview date and tells you the specific requirements of the visa. It includes instructions on where to go to have the required medical examination. During the interview process, an ink-free, digital fingerprint scan will be taken. Some visa applications require further administrative processing which takes additional time after the visa applicant’s interview by a Consular Officer. In general, the following is required:
A passport valid for travel to the United States and with a validity date at least six months beyond the applicant's intended period of stay in the United States.
Birth certificate
Divorce or death certificate of any previous spouse
Marriage certificate
Police certificate from all places lived since age 16
Medical examination
Evidence of financial support. A completed Form I-864 Affidavit of Support from petitioner/sponsor is required.
