The Legal Standpoint On Pornography And Prostitution

What is the real difference between pornography and prostitution? Some people view it as the same thing yet the law allows pornography and it does not legalize prostitution. It can be said to be two sides of the same coin. The two practices should acquire the same protection grounds. This was a case in Manhattan District Attorney's office where the complaint moved to court to challenge the tendency of prosecuting the escort services and totally ignoring adult film production. According to Paulino who was the complaint, the two practices are the same activity. Paulino claimed that rejecting the ruling is allowing one form of prostitution and rejecting another. Justice Budd G. Goodman rejected this case on the grounds that pornography is not prostitution in the current New York stature.

Justice Goodman explained that prostitution is defined as real exchange of commercial sex between a prostitute and a client. The judge explained that the legal line between pornography and prostitution is in the meaning of the law. If we are eager to get the right interpretation, prostitution is when a client pays a prostitute to perform sexual acts on him or her, while pornography is is when a client pays an actor to perform same sexual acts on another actor. According to my own understanding prostitution involves exchange of sex for money. Wherever there is exchange of sexual gratification for material possession, that is prostitution and it does not matter the name it is given. When the addicts of pornography watch two people having sex, they are sexually aroused and therefore they experience imaginative sexual gratification. I insist that pornography is prostitution since if the viewers did not like it they wouldn't be obsessed to an extent of handing out money.

Many people including the judge in Manhattan believe that there is a distinction between pornography and prostitution since one involves direct physical sexual encounter and the other involves watching others do it without receiving sexual favors in return. This has lead to flourishing of pornographic film industry without any interference from the legal corridors. If people continue to ignore pornography, prostitution will forever remain in our society. You will agree with me that, it is when people watch pornography that they are pushed to have some weird sexual acts performed on them. They pay a prostitute to actualize their imagination.

In other words pornography is like having prostitutes to engage in sex in front of a camera for a certain fee. I know you will tell me that in pornography actors are pretending while in prostitution the parties are actually enjoying sex but i fail to understand how pretence and reality are different from a legal standpoint. In fact the blue movies distributors should be prosecuted on the grounds of promoting prostitution. Most amendments and legal principals protect its distribution. Drug dealers involved with selling marijuana are prosecuted for carrying out illicit transactions. If there are some audience watching the drug dealing process, they won't be arrested but the drug dealers will be on the wrong side of the law. The same should happen to the actors of pornographic film. The practice is as wrong as drug dealing. Pornography and prostitution are one and the same thing.
